These General Conditions govern the purchase of products through our online store www.lavinaventura.com and are effective together with our Privacy Policy and our Cookies Policy.

This merchant undertakes not to allow any transaction that is illegal, or that is considered so by the credit card brands or the acquiring bank, and that could or has the potential to damage their goodwill or adversely affect them. The following activities are prohibited under the card brands' programs: the sale or offer of a product or service that is not in full compliance with all applicable laws to the Buyer, Issuing Bank, Merchant, Cardholder, or cards. In addition, the following activities are also expressly prohibited:
· The sale of alcoholic beverages to people under 18 years of age.
The use of the Website's services, as well as the purchase of any of the products offered, means that the User accepts, without reservation of any kind, each and every one of these General Conditions. Registration in the Portal and the use of the services implies that your data as a User will become part of the files of La Vinaventura, and will be processed in accordance with the provisions of the Privacy Policy, which the User expressly declares to know and accept.
La Vinaventura provides information about products, and offers the possibility of purchasing them through the Website. Persons who wish to purchase products must complete the respective registration form prior to the purchase process and follow the steps that La Vinaventura subsequently communicates via the Website.
These General Conditions, together with the Legal Notice and the Privacy Policy of the Website, are the only conditions applicable to the use of the Portal and to the purchase of products through it, and supersede any other conditions, unless previously agreed in writing between La Vinaventura and the User. Consequently, the User accessing the Website, filling out the purchase form, and making a purchase through the Portal agrees to submit to and be bound by the General Conditions, the Legal Notice and the Privacy Policy as they are drafted at the time of accessing the Website.
2.- Information about the products
The photographs of La Vinaventura Products, as well as trade names, brands, or distinguishing marks of any kind contained on the Website, are intended to provide as much information as possible; however, the User should be aware that they are given for guidance purposes and consequently should not be considered exhaustive.
La Vinaventura reserves the right to decide, at any time, which products are offered to Users through the Portal. Thus, La Vinaventura may at any time add new products to those included in the Portal, it being understood, unless otherwise stated, that such new products will be governed by the provisions of the General Conditions in force at that time.
Likewise, La Vinaventura reserves the right to discontinue, at any time and without prior notice, access to any of the products offered on the Portal.
In the event that, due to circumstances of force majeure, a product is not available after purchase has been made, La Vinaventura will inform the User by email of the total or, where appropriate, partial cancellation of the order. Partial cancellation of the order does not entitle you to the cancellation of the entire order, without prejudice to the exercise of the right of withdrawal as set out in these General Conditions.
3.- Product purchase system
To proceed with the purchase of the product, the User, who must be over eighteen (18) years of age, must select the product they wish to buy and add it to the Shopping Cart. Once the selection of products to be purchased has been completed, the User must click the "Finish" icon. Next, the selected products to be purchased will be shown and the User must choose between shipping the products to an address or picking up the order at La Vinaventura, Major de Sarrià, 7, At. 3a - Barcelona, 08017 Barcelona. Finally, the user must click the "Pay" icon.
The username and email address provided to La Vinaventura are identification and enabling elements to access and make purchases, and have a personal and non-transferable nature. Once the purchase process is completed, La Vinaventura will send to the email provided by the User a confirmation email of the order receipt within twenty-four (24) hours of placing the order. The order confirmation sent by La Vinaventura will not be valid as an invoice, but only as proof of purchase. The Customer Service Department of La Vinaventura will send the User the corresponding invoice within thirty (30) days from the time of purchase.
4.- Product prices
The prices of the products offered through the Website include all applicable taxes. The shipping costs for the products, borne by the buyer, will be detailed and itemized in the "Your Basket" section of the Website.
La Vinaventura reserves the right to modify the prices displayed on the Website at any time. Products will be invoiced at the price in effect as displayed on the Website at the time the order is placed.
5.- Payment for products
Payment for the purchased goods and shipping costs, which will appear on the screen, can be made by credit or debit card, bank transfer, or directly in cash or by card upon collection of the order at La Vinaventura, Major de Sarrià, 7, At. 3a - Barcelona, 08017 Barcelona.
To proceed with payment, the User must follow the instructions displayed on the screen.
The User must notify La Vinaventura, via hola@lavinaventura.com, of any unauthorized or fraudulent charges on the account provided for purchases on the Website, as soon as possible, so that La Vinaventura can take the measures it deems appropriate.
6.- Product delivery
La Vinaventura undertakes to deliver the products purchased by the User during the purchase process as soon as possible, and in any case, within a period of seven (7) calendar days from the date of the order. Delivery will be made to the address provided for this purpose during the registration process with La Vinaventura, c/ Major de Sarrià, 7, At. 3a - Barcelona, 08017 Barcelona.
La Vinaventura will not be responsible for any errors or losses caused during delivery if the delivery address provided by the User does not correspond to the desired place of delivery by the User.
7.- Product returns
(i) Right of Withdrawal
The User will have a maximum period of fourteen (14) calendar days from the delivery of the product to fully or partially withdraw from the purchase of the product, in accordance with applicable law.
Once the period of fourteen (14) calendar days has elapsed, La Vinaventura will not accept returns for withdrawal from purchases of products.
In the event of withdrawing from the purchase of a product, the User must contact La Vinaventura by sending an email to hola@lavinaventura.com.
In any case, in the event of withdrawal, the following requirements must be met:
1) The product must be in the same condition as delivered and must keep its original packaging and labeling.
2) The return to La Vinaventura must be made using the same box or envelope used in the delivery or, failing that, in a similar format that guarantees the return of the products in perfect condition.
3) A copy of the purchase receipt and the delivery note for the products must be included in the package, indicating the returned products and the reason for the return. Returns of orders must be sent to the address of La Vinaventura, Major de Sarrià, 7, At. 3a - Barcelona, 08017 Barcelona. The User will bear the shipping costs for returns in case of exercising the right of withdrawal.
(ii) Return of defective products
Without prejudice to any other rights that may correspond to them, the User has the right to a refund of the price of defective products or of products delivered that do not correspond to the order placed by the User. Alternatively, the User has the right to request and receive an identical product in perfect condition.
In the event of returning defective products or products that do not correspond to the order to La Vinaventura, the User must do so via the procedure established in section (i) above, but the User will not be responsible for returning costs of these products in this case.
Provided that the User has followed the procedure established in section (i) above and the requirements specified in this section have been met, La Vinaventura will refund the price paid for the returned products that are defective or do not correspond to the order placed by the User, in accordance with the provisions set out in section (iii) below.
(iii) Refund of the price of products to the User
Provided that the User has followed the procedure set out in this section and the requirements set forth herein have been met, La Vinaventura will refund the price paid by the User for the returned products. In case the return is made by exercising the User's right of withdrawal described in section (i), La Vinaventura will not pay or bear any return shipping costs and/or expenses.
The User will not be entitled to a refund for the returned products if they are not in the same condition as delivered, or if the requirements established in these General Conditions are not met.
Partial returns of an order will result in a refund of the price corresponding to the product(s) actually returned.
La Vinaventura will process the refund order through the same payment method used by the User to purchase the products, within seven (7) days from the receipt of the returned order and once La Vinaventura has checked that the returned products comply with the requirements set out in sections (i) and (ii) above. The application of the refund in the User's account will depend on the banking institution.
8.- Modification of the General Conditions
La Vinaventura reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Website, as well as the General Conditions. Users will always have these General Conditions in a visible place, freely accessible for any consultation they wish to make. Users agree to read these General Conditions carefully each time they access the Website's store. In any event, acceptance of the General Conditions will be a prior and indispensable step to contracting any product available through the Website.
9.- Communications between La Vinaventura and the User
All communications between La Vinaventura and the User relating to these General Conditions or to the purchase of products through the Website will be made in writing and in accordance with the communication procedures set forth in these General Conditions for each specific case.
For any other situations not expressly regulated in these General Conditions, any communications that the User wishes to send to La Vinaventura will be addressed to the address of La Vinaventura indicated in the First Condition and will be made in writing and through a system that allows proof of the content and receipt by La Vinaventura of the relevant communication.
10.- Integrity of the General Conditions
The present General Conditions, the Privacy Policy and the Legal Notice constitute the express and sole will of La Vinaventura and the User in relation to their subject matter and invalidate and replace any other agreements or contracts, verbal or written, previously made by the parties.
11.- Partial Nullity
Should any Clause of these General Conditions be declared void, it will be removed or replaced. In any case, such declaration of nullity will not affect the validity of the remaining provisions included in these General Conditions.
12.- Applicable Law and Jurisdiction
These General Conditions are governed by and interpreted in accordance with Spanish law.
In the event of any discrepancy or claim between the parties regarding the compliance or content of these General Conditions, the parties agree to submit the decision of the matter to the competent Courts and Tribunals in accordance with applicable law.
